East Suffolk and North Essex NHS Foundation Trust (the "Trust") intends to enter into a Landlord’s Licence for Alteration; Agreement for Underlease and Underlease with Noviniti Colchester Limited ("Noviniti") in respect of a retail development at Colchester General Hospital. The Trust has structured the contractual arrangement as a land transaction exempt from the Public Contracts Regulations 2015 and Directive 2014/24/EU.The Trust and Noviniti has entered into the Option Agreement and Ground Lease in respect of the site for the proposed retail development as detailed in the voluntary ex-ante transparency notice 2018/S 246-563190 published in the OJEU on 21.12.2018.
