Canterbury City Council wishes to select and appoint a suitable supplier for the provision of Public Building Maintenance and invites tenderers to submit a tender to meet the Council's requirements. The specific requirements for the above are detailed in the Invitation to Tender documents. It should be noted that by submitting a tender, you confirm that you understand and can meet these requirements. It is a condition of the Invitation to Tender that all contractors attend an accompanied site visit, which is expected to take half a day and will be at locations in Canterbury and Whitstable. Any contractor who does not attend one of these site visits will be disqualified from the tender process. Available dates are listed within section 2.2.6 along with further details on booking. The Contract is anticipated to commence June/July 2022 and will continue for a period of 2 years (unless terminated early in accordance with the terms and conditions of the Contract), and may be extended for a period of 2 x 1 year extensions subject to the satisfactory performance of the Services by the Contractor and at the Council's entire discretion. Any such extension shall be on the same terms and conditions of this Contract and shall be subject to mutual agreement in writing. This contract seeks to replace the contract procured earlier this year which was awarded to DCB (Kent) Ltd who are now in administration. With administrators having been appointed the Council seeks to obtain confirmation in relation to any TUPE transfers. Until such time as an updated TUPE list is received by the Council it has been decided to provide the slightly older list which was used for the initial procurement. The Council would also like to point any tenderer to Regulation 8 of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (as amended). The Council is unable to provide any information or advice regarding TUPE and each tenderer should obtain their own legal advice regarding this. Due to the Council not having obtained an up to date TUPE list it has been decided that tenderers interested in bidding for the contract opportunity to have to set out the costs excluding any TUPE costs in the pricing schedule with a separate row indicating potential TUPE costs. Shall the costs be lower than included in that separate row the successful tenderer shall only be entitled to charge the costs which have been incurred and provide the relevant evidence in support of this You are required to complete and return the non-disclosure agreement via the MESSAGE FACILITY of the portal to allow the indicative TUPE list to be issued to you.
