Forthside District Heating Network Supply of Heat - Supply Contract

The Council has secured LCITP funding of 1.9 million GBP from the Scottish Government in relation to the construction of an energy centre and district heating network. This contract is for the supply of heat from the energy centre to the district heating network. The contract is for a 20 year term, with the potential to be extended by agreement of the parties. Justification for selected award procedure: The procurement falls outside the scope of application of the Directive Explanation: For the purposes of this contract the Council is regulated as a Utility, as it is a contracting authority engaged in the activity of the provision and operation of a heat network. See Article 8(1) of Directive 2014/25/EU and the corresponding implementing provision of regulation 8 of the Utilities Contracts (Scotland) Regulations 2016. Article 23(1) of Directive 2014/25/EU (and regulation 22 of the implementing regulations referred to above) provides that the Directive/regulations do not apply to procurement for the award of a contract by a utility active in the energy sector (by reference to Article (1)) for the supply of energy.
