The award of this contract under the Negotiated Tendering Procedure under Regulation 33 (1) (b) of the Public Contracts (Scotland) Regulations 2015 and Standing Order 9.3.1 (b) of the Council’s Standing Orders on Contracts for the following reason: - The services can be supplied by only one suitable provider because competition is absent for technical reasons. Intelligent Health Ltd developed the Beat the Street programme and are the only organisation who can provide these services. They have exclusive rights in the programme in the form of Intellectual Property Rights which require to be protected and as such no alternative or substitute exists.
