Supply of Wound Care Products

The Covid-19 outbreak has given rise to an urgent need for the supply of supply of wound care products via a new short term contract (effectively continuing existing service provision). An open tender process was published on 6 February 2020, in order to procure a new service, but no compliant bids were received (OJEU Ref: — 2020/S 028-065827). Under the Public Contracts Regulations 2015, the contracting authority considers Covid-19 to be a state of urgency that has been brought about by circumstances which a diligent contracting authority could not have foreseen. A response to the pandemic is therefore required in order to safeguard public health risks and risk to life by securing safe and continued service provision. Accordingly, the Isle of Wight Clinical Commissioning Group (CCG) has decided to enter into a contract with ConvaTec Ltd using the ‘competitive procedure without prior publication for reasons of extreme urgency’ (Reg 32(2)(c) PCR 2015).
