Research and development of Impact Assesments for compliance to proposed new law in Wales related to children's rights - UNCRC.The purpose of these projects is to develop tools that can be used to ensure compliance with the duties in the proposed Measure, associated guidance and training which can be used by Welsh Assembly Government Officials to ensure compliance primarily with the Due Regard and promoting knowledge duties outlined in the proposed Children and Young Persons (Wales) Measure. As a starting point, these will need to draw upon models developed elsewhere relating to children’s rights based impact assessments.Lot 1 will provide an assessment tool which covers decisions which relate to policy and legislation and Lot 2 will provide an impact assessment relating to budget/financial decisions.From previous legal cases where a duty to have due regard has been examined the following list highlights important elements in complying with a duty to have due regard. This may form a basic template for arrangements for compliance.a. Making those who have to take decisions that do or might affect children aware of their duty to have due regard to the Conventionb. The duty must be fulfilled before and at the time that a particular policy/function that will or might affect children is being considered. It involves a conscious approach and state of mind.c. The duty must be exercised in substance, with rigour and with an open mind and should be integrated within the discharge of the public functions of the authority. It is not a question of ticking boxesd. The duty is non-delegablee. The duty is a continuing onef. Proper record keeping encourages transparency and is expected of those carrying out the function to undertake their duties conscientiously.
