The NWUPC has a requirement to establish a Framework Agreement for the provision of Vehicle Hire, Car Club and Vehicle Leasing. NWUPC is managing this procurement process in accordance with the Public Contracts Regulations 2015 (the ‘Regulations’) on behalf of members of NWUPC, NEUPC, APUC, HEPCW, SUPC, LUPC and CPC consortia.1.2.2 The NWUPC is establishing the Framework Agreement as a central purchasing body for itself and Its Members (Other Contracting Bodies (OCB)). This means that Members referred to in the OJEU Notice may also participate in the Framework Agreement.1.2.3 The Contract Notice has been advertised in the Supplement to the Official Journal of the European Union and on Contracts Finder and the process is being conducted under the EU Procurement Directive's, Open Procedure.1.2.4 The Tenderer is the Economic Operator, as defined in the Regulations, responding to this Invitation to Tender by submitting a response for the consideration of NWUPC.1.2.5 The Tender process is being led by NWUPC; the main point of contact for the duration of this exercise is:David LambContracts and Training ManagerNWUPCAlbert House17 Bloom StreetManchesterM1 3HZAll communication should be directed to NWUPC as outlined in 3.4.1.3 Scope and Objective of the Framework Agreement1.3.1 The NWUPC is seeking to establish a multi-provider Framework Agreement on behalf of the members of NWUPC, NEUPC, HEPCW, APUC, SUPC, LUPC and CPC for Vehicle Hire, Car Club and Vehicle Leasing.1.3.2 Tenderers shall accept and acknowledge that by issuing this ITT NWUPC shall not be bound to accept any Tender and reserves the right not to conclude a Framework Agreement for Vehicle Hire, Car Club and Vehicle Leasing for which Tenders are invited nor does it constitute an offer to enter into a contractual relationship.1.3.3 All costs incurred in relation to preparing and submitting a Tender are to be borne by the Tenderer. NWUPC shall not accept liability for any associated costs sustained by Tenderers.1.3.4 This Framework Agreement will commence on 1st February 2017 for an initial period of 24 months until 31st January 2019 with the option to extend the Framework Agreement for a further 12 months until 31st January 2020 and a further 12 months until 31st January 2021 subject to satisfactory Economic Operator performance.1.3.5 The Framework Agreement will be split into three lots as follows:Lot 1 — Vehicle HireLot 2 — Car ClubLot 3 — Vehicle Leasing1.3.6 The Tenderer can apply for a single lot or for multiple lots. You will need to complete and return a separate ITT and the appropriate appendices for each of the lots You wish to apply for. However you must indicate in section 4 Lot Application which of the lots You wish to apply for. This document refers to Lot 1 Vehicle Hire. A separate ITT document is available, and should be completed for the other Lots. Each bid will be assessed on its own merits and each lot will be awarded separately. Successful award on a particular lot does not enable You to supply under any other Lot.1.3.7 Lot 1 Vehicle Hire includes, but is not limited to, the following scope; The hire of vehicles, participating Consortia Members will have a requirement primarily for cars (including 4X4 off road vehicles and MPV's) and vans within the UK; however there will also be a need for all types of hire vehicles including but not limited to self-drive mini buses, low emission vehicles, disability access vehicles and HGV and HCV in both manual and automatic drives inside and outside the UK. NWUPC is looking for Tenderers who will actively promote and market the Framework Agreement. The competitiveness, level of service offered, and marketing effort of the successful Economic Operators will be a large factor in determining how many Institutions support the Framework Agreement. The expenditure achieved by each Economic Operator via the Framework Agreement will be reviewed on the anniversary of the Framework Agreement each year. If an Economic Operator fails to achieve any expenditure during that period, consideration will be given to removing that Economic Operator from the Framework Agreement.1.4.4 The Framework Agreement is open to the current Member Institutions & affiliated Public Sector Bodies including FE colleges and the Research Councils (http://www.rcuk.ac.uk/) as defined by the above Consortia. Any other HE or FE Institution within the UK wishing to participate in this agreement is only able to do so via a subsequent application that is accepted by the NWUPC. The membership of the Consortia may change in the future owing to strategic realignment or the inclusion of new full or associate members, who could be outside the education/research sector, but within the public sector. Institutions that are not members of the Consortia may be subject to the payment of additional access fees on an annual basis to the coordinating body in respect of their use of the Framework Agreement. The agreements will also be made available, during their incubation period, to those participating Institutions' spin-off companies where 50 % or more of their equity is owned by a participating Institution or group of participating Institutions.1.4.5 At some point during the life of the Framework Agreement the current members of the following may wish to utilise the Framework Agreement and should have access at any point with the permission of NWUPC. This Framework Agreement is not intended to replace any current Agreements that either participating or non-participating Institutions may already have in place.
