Warthog Post Design Services (PDS) Contract.

Military vehicles and associated parts. Protected Mobility Team (“PMT”), as part of the UK Ministry of Defence (“MoD”), intends to exercise an option to extend an existing contract with Singapore Technology Kinetics Ltd for Post Design Services (“PDS”) for the WARTHOG vehicle for a further two years. It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011).This because Singapore Technology Kinetics Ltd have access to the original drawings and associated confidential manufacturing data and underlying technical know-how needed to provide the Design Authority (DA) service required as part of the PDS contract. The contract requires the supplier to provide modification and ballistic repair schemes. All these modifications to the platform must be underwritten by the DA to provide the MoD with the required assurance that the modifications will not compromise either operational effectiveness or safety of the vehicles. Without access to the DA data, any modifications developed by a third party would need to be supported by a completely new Safety Case at considerable time and expense to provide the necessary confidence that the integrity of the vehicles has not been compromised. This additional obligation would result in disproportionate technical and safety difficulties which would have an impact on the effectiveness of operations together with a disproportionate impact on time and cost.
