The Thames Tideway Tunnel project will modernise London's sewerage system, delivering environmental and economic benefits to the UK's capital for generations.A major new sewer, the “Thames Tideway Tunnel”, is urgently needed to provide long overdue and necessary additional sewer capacity to protect the River Thames from increasing pollution. It will help tackle the problem of the capital's Victorian sewers overflowing into the River Thames and enable the UK to meet European environmental standards. The Thames Tideway Tunnel will run to approximately 25 km long and up to 70 m deep underground (requiring excavation), broadly following the River Thames and will connect with Thames Water Utilities Limited's (“Thames Water”) existing sewer network.On 4.6.2014, the Department of Environment Food and Rural Affairs (“Defra”) issued a notice specifying the Thames Tideway Tunnel as a ‘specified infrastructure project' (“Specification Notice”) under the Water Industry (Specified Infrastructure Projects) (English Undertakers) Regulations 2013 (“SIP Regulations”) and a further preparatory work notice describing preparatory work that Thames Water is permitted or required to undertake for the Project (“Preparatory Work Notice”). These notices took effect from 5.6.2014. Pursuant to the SIP Regulations, Thames Water is required to tender the project that has been specified and is prohibited from carrying out that project except for the work described in the Preparatory Work Notice. Pursuant to this contract notice, Thames Water is putting the design, construction, ownership, operation of the Thames Tideway Tunnel project together with the associated financing (the “Project”) out to tender.Following the tender of the Project, Thames Water will select a party to finance, design, construct, own and operate the Project on the basis of the most economically advantageous tender. Subject to compliance with the requirements of the SIP Regulations, it is expected that the Water Services Regulation Authority (“Ofwat”) will designate the successful bidder as an ‘infrastructure provider' (as that term is defined in the SIP Regulations) (“Infrastructure Provider”) pursuant to regulation 8(1) of the SIP Regulations and grant it a Project licence (“Project Licence”). Following designation and licensing, the Infrastructure Provider will commence the Project and will enter into a number of contracts in relation to these responsibilities. These are further described in section II.2) of this notice and the invitation to negotiate (“ITN”) to be issued to bidders that have been selected to tender for the Infrastructure Provider.Interested parties will be able to download a pre-qualification questionaire letter (the “PQQ Letter”) including a briefing document (“Briefing Document”) which is an appendix to the PQQ Letter, once they have registered their interest in becoming a bidder for the Infrastructure Provider to carry out the Project via the registration process set out in section III.2) of this notice.The PQQ Letter and the Briefing Document contain further detail regarding the timeline and phases of the procurement of the Infrastructure Provider ("Procurement"), the Project's structure and key features, including details of the support to be provided by the UK Government for extraordinary risks, the regulatory revenue mechanisms, the interface with Thames Water as well as specific details regarding the pre-qualification phase, including the pre-qualification questions that each interested party must respond to and the way in which Thames Water will assess the responses to the PQQ Letter.Whilst it is intended that the Procurement will be run in accordance with the timeline and process described in the PQQ Letter, the ITN and in this notice, Thames Water reserves the right to amend or cancel any or all of the Procurement at anytime.Interested organisations should refer to sections II.2 (Quantity or scope), VI.3 (Additional information) of this notice, the PQQ Letter and Thames Water's website for the Project at http://www.thamestidewaytunnel.co.uk/ for further information regarding the Infrastructure Provider and the Project generally.
